01Objeto del servicio

Pico.Love OS es un sistema de marketing con inteligencia artificial. Permite a organizaciones planear, producir, publicar, medir y responder contenido de marketing en redes sociales, con apoyo de inteligencia artificial. Estos términos aplican a toda persona que use Pico.Love OS en nombre de una organización cliente.

02Tu cuenta y tus responsabilidades

• Eres responsable de mantener segura tu cuenta y tus credenciales de acceso.
• Eres dueño de tu contenido: logos, imágenes de producto, lineamientos de marca y todo lo que subas al sistema.
• Eres responsable de tener los derechos necesarios sobre lo que publicas — incluido lo generado con IA, antes de publicarlo — y de cumplir las políticas de Meta y de cualquier otra plataforma que conectes.
• No puedes usar el sistema para publicar contenido ilegal, que infrinja derechos de terceros, o que viole las políticas de las plataformas conectadas.

03Contenido generado con inteligencia artificial

El sistema usa inteligencia artificial para generar copy, imágenes y video a partir de tus lineamientos de marca. Ese contenido es una propuesta: tú lo revisas y apruebas antes de que se publique. Pico Love no es responsable del contenido que apruebes y publiques a través del sistema.

04Disponibilidad del servicio

Trabajamos para que el servicio esté disponible de forma continua, pero no lo garantizamos libre de interrupciones o errores. Podemos hacer mantenimiento, actualizaciones o cambios que afecten temporalmente la disponibilidad, avisando cuando sea razonablemente posible.

05Dependencia de terceros

Pico.Love OS depende de plataformas de terceros — principalmente Meta (Instagram y Facebook) — y de proveedores de inteligencia artificial. Si alguno de estos terceros cambia, limita o suspende su API o sus políticas, y eso afecta el servicio, no lo consideramos un incumplimiento de nuestra parte. Haremos lo razonablemente posible por adaptarnos y avisarte.

06Limitación de responsabilidad

En la medida que lo permita la ley, la responsabilidad de Pico Love frente a ti se limita al monto que hayas pagado por el servicio en los tres meses previos al hecho que la origina. No respondemos por daños indirectos, pérdida de ganancias, de datos o de oportunidades de negocio.

07Confidencialidad

Ambas partes se comprometen a mantener confidencial la información no pública que reciban de la otra con motivo de este servicio, y a usarla solo para los fines de la relación entre ambas.

08Terminación

Puedes cancelar el servicio en cualquier momento avisando a os@pico.love. Podemos suspender o cancelar una cuenta que incumpla estos términos, que ponga en riesgo al sistema o a otros clientes, o por falta de pago, avisando con la anticipación razonable según el caso.

Al terminar, dejamos de tener acceso a tus cuentas conectadas. Tus datos se conservan según lo descrito en nuestro Aviso de Privacidad.

09Ley aplicable y jurisdicción

Estos términos se rigen por las leyes de México. Para cualquier controversia, las partes se someten a los tribunales competentes de la Ciudad de México, renunciando a cualquier otro fuero que pudiera corresponderles.

Pico.Love OS is an AI-driven marketing system. It lets organizations plan, produce, publish, measure, and respond to marketing content on social media, assisted by artificial intelligence. These terms apply to anyone who uses Pico.Love OS on behalf of a client organization.

02Your account and responsibilities

• You are responsible for keeping your account and access credentials secure.
• You own your content: logos, product images, brand guidelines, and anything you upload to the system.
• You are responsible for having the necessary rights over what you publish — including AI-generated content, before publishing it — and for complying with Meta's policies and those of any other platform you connect.
• You may not use the system to publish illegal content, content that infringes third-party rights, or content that violates the policies of connected platforms.

03AI-generated content

The system uses artificial intelligence to generate copy, images, and video based on your brand guidelines. That content is a proposal: you review and approve it before it's published. Pico Love is not responsible for content you approve and publish through the system.

04Service availability

We work to keep the service continuously available, but we don't guarantee it will be free of interruptions or errors. We may perform maintenance, updates, or changes that temporarily affect availability, notifying you when reasonably possible.

05Third-party dependence

Pico.Love OS depends on third-party platforms — primarily Meta (Instagram and Facebook) — and on AI providers. If any of these third parties changes, limits, or suspends its API or policies, and that affects the service, we do not consider it a breach on our part. We will make reasonable efforts to adapt and to notify you.

06Limitation of liability

To the extent permitted by law, Pico Love's liability to you is limited to the amount you paid for the service in the three months prior to the event giving rise to the claim. We are not liable for indirect damages, or loss of profits, data, or business opportunities.

07Confidentiality

Both parties agree to keep confidential any non-public information received from the other in connection with this service, and to use it only for the purposes of the relationship between them.

08Termination

You may cancel the service at any time by notifying os@pico.love. We may suspend or cancel an account that breaches these terms, that puts the system or other clients at risk, or for non-payment, with reasonable notice given the circumstances.

Upon termination, we lose access to your connected accounts. Your data is retained as described in our Privacy Policy.

09Governing law and jurisdiction

These terms are governed by the laws of Mexico. For any dispute, the parties submit to the competent courts of Mexico City, waiving any other jurisdiction that might otherwise apply to them.
